San Jose

California, United States

OpenAI made the commitment Wednesday at a federal court hearing in San Jose, after Judge Edward Davila said he was highly likely to grant Apple a preliminary injunction. The judge can enforce the agreement.

Employees whose devices will be imaged

14 employees

OpenAI will also collect forensic images of devices belonging to 14 employees that may hold Apple's confidential information.

Ex-staff took its secrets

OpenAI says

Over 100 files went to Apple

Apple sued in July, accusing OpenAI of obtaining its product and supply-chain secrets through former Apple employees. OpenAI now says an employee who returned to Apple took more than 100 confidential files; Apple says it found no evidence of that.

What we know

  • OpenAI won't use the alleged secrets for now
  • The judge can enforce the agreement

Not yet

  • The scope of any injunction
  • Whether either side's claims hold up

The agreement gives Apple interim protection, but the case has not gone to trial and the scope of any injunction is still open.
