Wheels of aged cheese on shelves

A US cheese importer sues to overturn Trump's 50 per cent tariffs on Canadian goods

The Liberty Justice Center sued on Tuesday on behalf of Gellert Global Group, a New Jersey family firm paying 50 per cent tariffs on Canadian cheese. It asks the US Court of International Trade to declare the tariffs unlawful and order refunds.

The law at issue

Section 338

The tariffs rest on Section 338 of the Tariff Act of 1930, which no president had used before. The suit argues Congress replaced it with later trade law, and that the White House did not meet its terms.

"No president should have the power to pull a dormant statute off the shelf and use it to impose sweeping tariffs or import bans without the limits Congress required."

— Sara Albrecht, Liberty Justice Center

And us?

The tariffs hit about US$20 billion of Canadian goods, from wine to dairy and hockey sticks, and Canada matched them dollar for dollar. An administration official said Canada still discriminates against US dairy, alcohol and autos, and that the White House will defend the tariffs in court.
