Supreme Court of Canada agrees to hear the single-use plastics ban case

Items covered by the ban

  • Straws and stir sticks
  • Cutlery
  • Takeout containers
  • Six-pack rings

Since 2022, Ottawa has phased in a ban on making and selling six single-use plastic items, including straws, stir sticks, cutlery, takeout containers and six-pack rings.

Federal Court, 2023

Listing too broad

Court of Appeal, January

Listing reasonable

In 2023, the Federal Court found that listing plastic items as toxic was too broad. In January, the Federal Court of Appeal unanimously overturned that ruling and let the ban stand.

"The chemical content of (plastics) is irrelevant to the sea otter choking on a plastic straw. The problem is the plastic item itself, not its chemistry."

— Federal Court of Appeal judges

Environment Minister Julie Dabrusin's office says the ban stays in place until the Supreme Court rules. The plastics industry group that challenged it welcomes the chance to argue its case there.
